Protection and processing of personal data

I. Basic provisions

  1. The controller of personal data according to Article 4 point 7 of the Regulation of the European Parliament and of the Council (EU) 2016/679 on the protection of individuals in relation to the processing of personal data and on the free movement of such data (hereinafter referred to as: "GDPR") is Bohemia Pet Food s.r.o., ID: 241 64 950, with its registered office at Masarykova 1089/189, 252 19 Rudná (hereinafter referred to as: "the controller").

II. Sources and categories of processed personal data

  1. The controller processes personal data that you have provided or personal data that the controller has obtained based on the fulfillment of your order.
  2. The controller processes your identification and contact details and data necessary for the fulfillment of the contract.

III. Legal basis and purpose of processing personal data

  1. The legal basis for processing personal data is
    • fulfillment of the contract between you and the controller according to Article 6 paragraph 1 letter b) GDPR,
    • the legitimate interest of the controller in providing direct marketing (especially for sending commercial messages and newsletters) according to Article 6 paragraph 1 letter f) GDPR,
    • Your consent to the processing for the purposes of providing direct marketing (especially for sending commercial messages and newsletters) according to Article 6 paragraph 1 letter a) GDPR in conjunction with § 7 paragraph 2 of Act No. 480/2004 Coll., on certain services of the information society in case there was no order of goods or services.
  2. The purpose of processing personal data is
    • the processing of your order and the exercise of rights and obligations arising from the contractual relationship between you and the controller; personal data that is necessary for the successful processing of the order (name and address, contact) is required for the order, the provision of personal data is a necessary requirement for concluding and fulfilling the contract, without providing personal data it is not possible to conclude or fulfill the contract by the controller,
    • sending commercial messages and carrying out other marketing activities.
  3. The controller does not engage in automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.

IV. Retention period of data

  1. The controller retains personal data
    • for the time necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
    • until the consent to the processing of personal data for marketing purposes is revoked, for a maximum of …. years, if personal data is processed based on consent.
  2. After the retention period of personal data has expired, the controller will delete the personal data.

V. Recipients of personal data (subcontractors of the controller)

  1. Recipients of personal data are persons
    • involved in the delivery of goods / services / execution of payments based on the contract,
    • providing services for operating the e-shop and other services related to the operation of the e-shop,
    • providing marketing services.
  2. The controller does not intend to transfer personal data to a third country (to a country outside the EU) or an international organization.

    • Google Analytics - records cookies and website usage
    • Google Adwords - records cookies and website usage
    • Google Shopping - request for review, records email if you agree in the ordering process
    • Heureka - records purchase conversions and email for the "Verified by Customers" service
    • Zboží.cz - records purchase conversions and email
    • Sklik - records cookies, website usage, purchase conversions
    • MailChimp - records purchase conversions and email for sending and personalizing newsletters

VI. Your rights

  1. Under the conditions set out in the GDPR, you have
    • the right to access your personal data according to Article 15 GDPR,
    • the right to rectification of personal data according to Article 16 GDPR, or restriction of processing according to Article 18 GDPR.
    • the right to erasure of personal data according to Article 17 GDPR.
    • the right to object to processing according to Article 21 GDPR and
    • the right to data portability according to Article 20 GDPR.
    • the right to revoke consent to processing in writing or electronically to the address or email of the controller provided in Article III of these conditions. You can revoke consent at any time in your own customer account.
  2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe your right to personal data protection has been violated.

VII. Conditions for the security of personal data

  1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
  2. The controller has taken technical measures to secure data storage and storage of personal data in paper form, in particular secured/encrypted access to the website, encryption of customer passwords in the database, regular system updates, regular backups of the system.
  3. The controller declares that only authorized persons have access to personal data.

VIII. Final provisions

  1. By submitting an order from the internet order form, you confirm that you are familiar with the terms of personal data protection and that you accept them in full.

  3. The controller is entitled to change these conditions. A new version of the personal data protection conditions will be published on its website, and it will also send you the new version of these conditions to the email address that you provided to the controller.

These conditions come into effect on May 25, 2018.
